The laws discussed on this website are perhaps the most egregious of a substantial body of law designed to protect doctors, hospitals and HMOs from malpractice claims brought by their patients. The purpose of this brief essay is to contribute to the public's awareness of these laws and how one powerful special interest group (doctors, hospitals, HMOs and their insurers ) in our society has succeeded in obtaining great advantage over a more vulnerable powerless group (their patients). While the prosecution of malpractice cases will always be a very difficult and expensive task, repeal of these laws will contribute greatly to a more level playing field for the victims of malpractice, and their families.
